Terms
The terms for using graaft.co, for visitors in South Africa, Australia and beyond. Effective 26 October 2026.
Introduction and acceptance
Welcome to graaft.co. These terms govern your use of this website. By using the site, you agree to them. If you do not agree, please do not use the site.
We are Graaft Studio, formerly NicheSpeak, a brand, web, app and marketing studio working from Perth, Australia and Johannesburg, South Africa. In these terms, “we”, “us” and “our” mean Graaft Studio, and “you” means anyone who visits or uses the site.
About this site
graaft.co presents the studio, its services, its work and its notes. The content is for information only. Nothing here is an offer, a contract or professional advice, and you should not rely on it as such. Sending a brief does not create an agreement: any work we do together is governed by a separate written agreement that we both sign.
Who can use it
You may use this site if you can form a binding agreement under the law that applies to you. If you use it on behalf of an organisation, you confirm that you are authorised to accept these terms for that organisation.
The AI team and the pictures
The studio’s specialists are AI, one craft each, and Will and Dave refine and sign off what they draft. Their names and faces are made, not real people.
Some pictures on the site are mock-ups that show work in use, made with AI tools and finished by hand. Where a picture shows a business that is not a client, it is an illustration.
Our content, and your licence to use the site
The Graaft Studio name and logo, and the site’s copy, pictures, films and code, are owned by Graaft Studio or licensed to it, to the extent the law protects them. Client names, logos and work shown on the site belong to their owners. We give you a limited, personal, revocable licence to view the site for your own non-commercial use.
You may quote short passages with attribution and a link back. Anything more, such as copying or republishing the site’s content, needs our written permission. All rights we do not expressly grant you are reserved.
What you send us
If you send us a brief, a message, an idea or feedback, you confirm that you have the right to share it. We may use feedback and suggestions to improve our work, without obligation or payment to you. Please do not send us confidential information unless we have agreed in writing beforehand to receive it.
Acceptable use
Please use the site lawfully and with care. Do not bypass its security or access controls, send anything unlawful or infringing through it, misrepresent who you are, or use it to harm the studio or anyone we work with. We may limit, suspend or block access to protect the site, and report unlawful activity.
Links to other sites
The site links to other websites, and its notes play episodes from Spotify. We provide these for convenience, and they do not mean we endorse those sites. We do not control them, and we are not responsible for their content or their terms.
Privacy
We handle personal information as our Privacy Policy sets out, alongside these terms.
Disclaimers
We take care with this site, and we offer it as it is, and as available. We do not promise that the content is complete or current, or that the site will always be available or free of faults. This clause is subject to your rights under consumer law, set out below.
Your rights under consumer law
Some of the limits in these terms may not apply to you, because the law where you live gives you rights that cannot be set aside. Nothing in these terms removes those rights.
If you are in Australia. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where the law lets us limit, rather than exclude, our liability for failing to meet a consumer guarantee, and the services are not of a kind usually acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again, or paying the cost of having them supplied again.
If you are in South Africa. Nothing in these terms removes or limits any right you have under the Consumer Protection Act 68 of 2008, or asks you to waive one. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for loss caused by our gross negligence or that of anyone acting for us, or for fraud or wilful misconduct. Any limit on our liability applies only as far as the law allows.
Our liability
Please read this. Subject to your rights under consumer law above, and to the maximum extent the law allows, we are not liable for indirect or consequential loss arising from your use of the site, or for loss arising from matters outside our reasonable control, including the site being unavailable. Nothing in this clause limits liability that cannot lawfully be limited.
Changes
We may update, change or remove parts of the site at any time. We may also update these terms as the studio or its services change. When we make a substantive change, we post it here and update the date below. If you keep using the site after a change, you accept the updated terms. Changes are not retrospective.
General
If any part of these terms is found to be invalid or unenforceable, the rest stays in force. If we do not enforce a term, that is not a waiver of it.
These terms are governed by the laws of Western Australia, and its courts have jurisdiction on a non-exclusive basis. You may also have rights, and be able to bring a claim, under the law of the country where you live. If you are a consumer in Australia, the Australian Consumer Law continues to apply. If you are a consumer in South Africa, the Consumer Protection Act 68 of 2008 continues to apply.
